Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Waypoint Logic LLC, a limited liability company doing business as Real Travel AI ("Real Travel AI," "we," "us," or "our"), governing your access to and use of the Real Travel AI platform, website, mobile applications, and services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Acceptance of Terms

By creating an account, accessing, or using any part of the Service, you:

• Confirm that you are at least 18 years of age or the age of majority in your jurisdiction;
• Agree to comply with these Terms and all applicable laws and regulations;
• Acknowledge that you have the authority to enter into this agreement.

3. Changes to Terms

4. Account Registration and Security

4.1 Account Creation

5. Subscription and Billing

5.1 Subscription Plans

The Service offers various subscription plans ("Subscription"), including:

• Free Plan: Limited access to basic features at no cost;
• Trip Pass: One-time payment for 14-day full access;
• Pro Yearly: Annual subscription with recurring billing.

5.2 Billing and Payment

By subscribing to a paid plan, you agree that:

• You authorize us to charge your payment method on a recurring basis (for recurring subscriptions);
• You will provide accurate and complete billing information;
• You are responsible for all charges incurred under your account;
• Subscription fees are charged in advance at the beginning of each billing cycle;
• All fees are non-refundable except as expressly stated in our Refund Policy.

5.3 Automatic Renewal

Unless you cancel your Subscription before the end of the current billing period, your Subscription will automatically renew for successive periods of the same duration at the then-current subscription rate.

5.4 Cancellation

You may cancel your Subscription at any time through your account settings or by contacting us at support@realtravelai.com. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until that date.

5.5 Price Changes

We reserve the right to modify subscription fees at any time. We will provide at least 30 days' notice before any price increase takes effect. Your continued use of the Service after the price increase constitutes acceptance of the new pricing.

6. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal, fraudulent, or unauthorized purpose;
• Violate any applicable local, state, national, or international law;
• Transmit viruses, malware, or any malicious code;
• Attempt to gain unauthorized access to the Service or related systems;
• Use automated tools (bots, scrapers, spiders) to access the Service without permission;
• Reverse engineer, decompile, or disassemble any part of the Service;
• Interfere with or disrupt the Service or servers;
• Impersonate any person or entity or misrepresent your affiliation;
• Collect or harvest personal information of other users;
• Use the Service to send spam, unsolicited messages, or commercial communications.

7. Intellectual Property Rights

7.1 Ownership

The Service and all content, features, and functionality (including but not limited to software, text, images, graphics, logos, trademarks, designs, and AI-generated outputs) are owned by Waypoint Logic LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for your personal, non-commercial purposes;
• Download and print content solely for personal use.

7.3 User Content

By submitting content to the Service (feedback, reviews, suggestions, etc.), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, and distribute such content for any purpose related to operating and improving the Service.

8. AI-Generated Content and Disclaimers

8.1 AI Disclaimer

Real Travel AI utilizes Artificial Intelligence (AI) to generate travel recommendations, visa guidance, budget estimates, and itinerary suggestions. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, outdated, or incorrect;
• You should independently verify all critical travel information (visa requirements, entry restrictions, safety advisories, flight details) with official government sources and service providers;
• We do not guarantee the accuracy, reliability, or completeness of AI-generated content;
• You use AI-generated advice at your own risk.

8.2 No Professional Advice

The Service does not provide legal, financial, medical, or professional advice. AI-generated content is for informational purposes only and should not be relied upon as a substitute for consultation with qualified professionals.

9. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources (booking platforms, travel providers, etc.) that are not owned or controlled by Real Travel AI.

We:

• Do not endorse or assume responsibility for third-party content, products, or services;
• Are not liable for any damages or losses arising from your use of third-party services;
• Encourage you to review the terms and privacy policies of any third-party sites you visit.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT;
• WARRANTIES REGARDING AVAILABILITY, RELIABILITY, ACCURACY, OR COMPLETENESS OF THE SERVICE;
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not warrant that the Service will meet your requirements or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYPOINT LOGIC LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
• DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE;
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA;
• DAMAGES RESULTING FROM RELIANCE ON AI-GENERATED CONTENT.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless Waypoint Logic LLC, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use or misuse of the Service;
• Your violation of any law or rights of a third party;
• Any content you submit to the Service.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at support@realtravelai.com or through your account settings.

13.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms;
• Fraudulent, abusive, or illegal activity;
• Non-payment of subscription fees;
• Upon your request;
• Discontinuation or modification of the Service.

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through:

• Informal Negotiation: You agree to contact us at support@realtravelai.com to attempt to resolve any dispute informally before pursuing formal action.
• Binding Arbitration: If informal resolution fails, any remaining dispute shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. Arbitration shall take place in Atlanta, Georgia.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Real Travel AI regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
